CSEA/UCS 2011-2017 Tentative Agreement Office and the Office of Labor Relations. The Committee shall meet within 60 days of execution of this Agreement to begin work on developing the pilot program. The Committee shall establish the following: (a)schedule of time and leave infractions and penalties. (b)procedures and forms for implementing the hearing process (c)selection procedures for identifying independent umpire. (4)The pilot program created by this Committee shall go into effect in 2015 or upon a mutually agreed date by the parties if later than 2015. §12.10 Investigatory Notification. The Clerk of the Court of Appeals, the Presiding Justice of an Appellate Division, the Chief Administrative Judge, or the appropriate Deputy Chief Adminstrative Judge shall provide written notice by letter to an employee who was the subject of an investigation, with a copy to the Union Local President, when it has received a final report from the Unified Court System’s Inspector General’s Office indicating that the Inspector General has completed its investigation. ARTICLE 13 Printing of Agreement Subject to the prior approval of the “galleys” of the Agreement by both parties, the State shall cause this Agreement to be printed and shall furnish the Union with a sufficient number of copies for its use. Both parties agree that they will expedite the production of the final contracts and that they will not unreasonably delay the review of the “galleys” prior to the printed of the Agreement by the State. The State agrees to distribute to each current employee a copy of the Agreement and will furnish a copy of the Agreement to all new employees. In addition, as soon as practicable following the execution date of the Agreement, the State will supply each CSEA Local President with two copies of the contract booklet and two copies of the contract on a CD. Office of Court Administration Tentative Agreement special edition ARTICLE 13 Printing of Agreement The Agreement will be available on the UCS website upon ratification and final approval by the UCS and the Union. ARTICLE 14 Labor Management Committee 14.5(a) The UCS shall prepare, secure introduction and recommend passage by the Legislature of such legislation as may be appropriate and necessary to obtain an annual appropriation in the amount of $424,085 which shall be carried over from one fiscal year to the next but which shall lapse on March 31, 2011, to fund the operation and implementation of the Quality through Participation program or such other educational initiatives which seek to improve, professionalize or cross-train the workforce and to develop and train employees. All funding provided in this section must be encumbered by January 31, 2011. The parties have agreed that the available funding shall be used for programs that provide support to employees for education/NYS-CSEA Partnership for Education and Training reimbursement, un-reimbursed medical expenses, health and wellness programs, training, health monitoring programs and communications. The parties have agreed that for fiscal years 2008, 2009 and 2010, $250,000 of the $424,085 annual amount shall instead be contributed to the Employee Benefit Fund provided in Article 22. 14.5(b) The UCS shall prepare, secure introduction and recommend passage by the Legislature of such legislation as may be appropriate and necessary to obtain funding to purchase body armor for newly hired uniformed court officers who have completed six months of post Court Officer Academy graduation service and new employees, after six months of court system service, who became court officers as a result of a security transfer of function from a local government. All funding provided in this section must be encumbered by January 31, 2011. 14.5(c) The UCS shall prepare, secure introduction and recommend passage by the Legislature of such legislation as may be appropriate and necessary to obtain an appropriation to fund the purchase of or replacement of body armor in the amount of $600.00 times 25% of the number of uniformed officers in the bargaining unit on the date of execution of the Agreement less the number of uniformed officers who are expected to receive body armor in accordance with Section 14.5(b) of the Agreement. 14.5 Labor/Management Committee The UCS and the Union have agreed that a pilot program to prepare and store all performance evaluations electronically will be implemented during the term of the Agreement. The UCS and the Union shall establish a Labor/Management Subcommittee to address any issues that arise during the implementation of the pilot. 14.8 The UCS and the Union shall establish a Labor/ Management Subcommittee to discuss the disciplinary procedures, including the creation of an expedited time and attendance disciplinary procedure. 14.8 The UCS and the Union have agreed that a pilot to provide for electronic storage of an employee’s personal history folder will be implemented during the term of the Agreement. The UCS and the Union shall establish a Labor/Management Subcommittee to address any issues that arise during the implementation of the pilot. ARTICLE 21 Uniform and Equipment Allowance 21.1 The uniform and equipment allowance in effect on December, 2006 2010, shall remain in effect except as modified below. 21.2(a) Effective June, 2008 June 1 of each year, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $627.50 $652.50, if eligible under Section 21.4. The payment of the uniform and equipment allowance shall be in a separate check. (b) Effective December, 2008 December 1 of each year, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $627.50 $652.50, if eligible under Section 21.4. The payment of the uniform and equipment allowance shall be in a separate check. 21.3(a) Effective June, 2009, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $640, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. (b) Effective December, 2009, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $640, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. 21.3 Effective April 1 of each year, each employee who is required by the State to wear a uniform who does not have peace officer status shall receive an annual uniform and equipment allowance of $925, payable in equal parts in June and December of each year, if eligible under Section21.4. The payment of the uniform and equipment allowance shall be in a separate check. 21.4(a) Effective June, 2010, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $652.50, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. (b) Effective December, 2010, all employees with peace officer status required to wear a uniform shall receive a uniform and equipment allowance of $652.50, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. 21.4(a) To be eligible for the uniform and equipment allowance payable in June pursuant to Sections 21.1; 21.2(a) and 21.3 above, an employee must have been on the payroll on May 31. An employee on a leave of absence without pay on May 31 who returns to duty prior to the payment of the December allowance, shall receive the June allowance upon return to duty. (b)To be eligible for the uniform and equipment allowance payable in December pursuant to Section 21.1; 21.2(b) and 21.3 above, an employee must have been on the payroll on November 30. An employee on a leave of absence without pay on November 30 who returns to duty prior to the payment of the June allowance, shall receive the December allowance upon return to duty. 21.5(a) Each employee who is required by the State to wear a uniform who does not have peace officer status, shall receive an annual uniform and equipment allowance of $850, payable in equal parts in June and December of each year, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. (b) Effective April 1, 2008 , each employee who is required by the State to wear a uniform who does not have peace officer status, shall receive an annual uniform and equipment allowance of $875, payable in equal parts in June and December of each year, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. (c)Effective April 1, 2009, each employee who is required by the State to wear a uniform who does not have peace officer status shall receive an annual uniform and equipment allowance of $900, payable in equal parts in June and December of each year, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. (d) Effective April 1, 2010 , each employee who is required by the State to wear a uniform who does not have peace officer status shall receive an annual uniform and equipment allowance of $925, payable in equal parts in June and December of each year, if eligible under Section 21.6. The payment of the uniform and equipment allowance shall be in a separate check. 21.7 21.5 Notwithstanding the above, an employee who as a result of disciplinary action was on a leave without pay which exceeds five workdays at any time during the six month period preceding payment of the uniform and equipment allowance shall not be entitled to receive such allowance. 21.8 21.6 21.6(a) To be eligible for the uniform and equipment allowance payable in June pursuant to Sections 21.1; 21.2(a); 21.3(a); 21.4(a); 21.5(a); 21.5(b); 21.5(c) and 21.5(d) above, an employee must have been on the payroll on May 31. An employee on a leave of absence without pay on May 31 who returns to duty prior to the payment of the December allowance, shall receive the June allowance upon return to duty.
